Dangerous Driving

If the Prosecution can prove that you drove dangerously, including that you were driving a vehicle that was in a dangerous condition, the Court has the power to sentence you to prison for this offence, impose a fine, disqualify you from driving and may also require you to re-take your driving test and permanently confiscate your vehicle.

However, in order to secure a conviction it must be proved that the standard of your driving was below that of a competent driver and that as a result of this, you posed a risk of danger to other people or property.  This places a heavy evidential burden on the Police and the Prosecution.

Our thorough preparation at the early stages of your case will include looking carefully through the police officers statements and if necessary instruct an expert to give evidence.

The evidence against you will often come from Police officers who witnessed you driving and who are trained in giving evidence in Court.  Questioning Police officers yourself may put you at a disadvantage if you have not had any legal training and this is where we can help you. Our advocates specialise in cross-examining witnesses including Police officers so that you can fight your case on a level playing field giving you the best possible chance for success.
